If you are currently in the UK with leave as spouse or “unmarried partner” of a British or a settled person and the relationship breaks down then you are duty bound to inform the Home Office of the change in circumstances. Your sponsor may feel they have no choice but to inform the Home Office themselves and they may ask that your leave be curtailed. You may then consider either departing the UK voluntarily or else applying for further leave to remain in the UK under human rights. This is especially strong where you have British or settled children in the UK or else where you have children who have spent seven years or more in the UK. If you have evidence that you had suffered domestic violence from your sponsor then you may consider applying for indefinite leave to remain in the UK as victim of domestic violence. If you are a non-European Economic Area [EEA] family member of an EEA national then you may be able to apply for retained rights of residence if you had been married for three years of which at least a year was spent living together in the UK.
