You may be eligible for indefinite leave to remain as a victim of domestic violence if you were granted limited leave as a partner (other than a fiancé(e) or proposed civil partner) of a British citizen or a person settled in the UK (or also a member of HM Forces who has served for at least four years) and that during the last period of limited leave as a partner you were a victim of domestic violence.

If you have no funds available whilst you are applying under domestic violence you can request the destitution domestic violence concession. If successful you will be granted three months’ temporary leave to remain in the UK known as Leave Outside the Rules and during which period you will be eligible for claiming public funds (which are normally not permitted before having indefinite leave to remain in the UK) and before expiry of which you must submit your main application for indefinite leave to remain.

You may also be able to request a fee waiver of the £2,389.00 Home Office fees if you can satisfy them that on paying the fees you would be rendered destitute of accommodation and/or living costs.
